Do you need to change Patent Agent in CNIPA to pay Patent Renewal Fee ?
Answer:
There is no requirement to change the Patent Agent in China to pay the Patent Renewal Fee.
As per the practices regulated by the China National Intellectual Property Administraion (CNIPA), foreign-owned patents can be assigned to any China Firm with China Citizen for the payment of Patent Renewal fees.

The renewal official fees for various patents in China are determined by the China National Intellectual Property Administraion (CNIPA). These fees are paid to the government and are based on the fee schedule provided by CNIPA. After the patent right is granted, the term of the invention patent right is 20 years from the application date.
During the validity period of the patent, an annual fee is required to be paid every year.
Patents are renewed each year before the “due date” (the application date).
Patents can be renewed up to 3 months before the renewal due date.
You can still legally pay the annual fee within 6 months after the due date.
No surcharge fee will be charged for the first month of overdue buffer period.
After the second month, a 5% surcharge fee will be paid every month.
A 25% surcharge fee will be charged by the sixth month.
If the payment is not made 6 months after the due date, the patent will be expired.

How is the exchange rate for the selected currency to pay the annual patent renewal fee in China confirmed with your company?

Once your company confirms and signs the “Patent Appointment Confirmation Form,” we will use the selling exchange rate of the day on which Evershine prints the “Patent Payment Receipt” as provided by China Bank to convert the fee into the selected payment currency of your company.

They will then generate a “Patent Entrust Confirmation Form” that lists the official fees in New China Dollars, along with the Evershine service fee.

Workflow of China Patent Renewal Service as below::

Step 1:
Foreign patent owners or patent law firms provide “Major Patent Information”: Patent Granted by CHINA, Patent application number, Patent publication number , chosen payment location and currency.
Step 2:
Based on the above ”Major Patent Information , we use RPA (Robotic Process Automation) to obtain the patent detailing information from China IPO and check the correctness of the data, and then generate “Annual Patent Fee Confirmation Letter.”
Step 3:
Send “Annual Patent Fee Confirmation Letter” by email for client confirmation.
Step 4:
Use the confirmed “Patent Annual Fee Confirmation Letter” to run a “Patent Annual Fee Payment Notice”.
Step 5:
The client takes the “Patent Annual Fee Payment Notice” to remit the money to Evershine Subsidiary. The remittance can be made by ATM, bank counter or other collection and payment.
Step 6:
After receiving payment from you through Evershine BPO Services Inc, immediately notify the responsible Evershine colleague in CHINA , accessing the website of the intellectual property o office of CHINA, to pay patent annual fee through Evershine China bank account.
Use RPA (Robotic Process Automation) to check if successful to pay out at CNIPA and raise the alarm if it is unsuccessful.
After making the payment, we will obtain the government fee receipt and forward it to the patent holder in China. We will also obtain and provide your company with the relevant certificates: remittance receipt, renewal certificate, and a link to the updated status on the website.
